You may be entitled to a payment from a class action settlement which has been preliminarily approved by the 43rd Circuit Court of Clinton County, Missouri (the “Court”) if, during the period from June 7, 2018, to July 18, 2024, TVS Datasource, provided a Consumer Report concerning you for employment purposes.

The lawsuit concerns whether Datasource fully complied with the mandates of the Fair Credit Reporting Act. As part of this lawsuit, the parties have also reached an agreement concerning injunctive relief regarding certifications obtained in the future by Datasource. If you have received the Notice and Claim Form it's because the litigants have negotiated a settlement and Datasource’s records show that you may be entitled to a payment from the settlement as a member of one of the Classes described below. Datasource disputes any wrongdoing.

Certification Class: All individuals who were the subject of one or more Consumer Reports in which the Defendant failed to obtain a 15 U.S.C. §1681b(b)(1) certification immediately prior to producing a Consumer Report from June 7, 2018, to July 18, 2024.

§1681k Class: All individuals who were the subject of one or more Consumer Reports in which Defendant included matters of public record that were likely to have an adverse effect upon a consumer’s ability to obtain employment without giving contemporaneous notice or maintaining strict procedures from June 7, 2018, to July 18, 2024.

Adverse Action Class: All individuals who were the subject of an alleged adverse action taken by the Defendant in violation of 15 U.S.C. §1681b(b)(3) from June 7, 2018, to July 18, 2024.

YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT:
RETURN THE POSTCARD TO BE ELIGIBLE FOR PAYMENT To claim your payment from the settlement of up to $100.00, please print your name and sign the postcard, and place it in the mail (no postage is necessary). Claims must be received by October 11, 2024.
EXCLUDE YOURSELF Get no payment. This is the only option that allows you to ever be part of any other lawsuit against Datasource about the legal claims in this case.
OBJECT Write to the Court about why you don’t like the settlement. You will still be bound by the Settlement terms.
DO NOTHING You will not receive a settlement payment, but you will be bound by the Settlement’s terms, and won’t be able to ever be part of any other lawsuit against Datasource about the legal claims in this case.
  • October 11, 2024: If you wish to participate in the settlement and be eligible to receive a settlement payment, you must file a Claim Form by mail with the Claims Administrator so that it is postmarked by this date.

  • October 11, 2024: If you want to be excluded from the class, you must mail your written Exclusion Letter so that it is postmarked by this date.

  • October 11, 2024: If you are a member of the class and you do not believe that the proposed settlement is fair, adequate, and reasonable, your written objection must be filed and received by the Court by this date.
