You may be entitled to a payment from a class action settlement which has been preliminarily approved by the 43rd Circuit Court of Clinton County, Missouri (the “Court”) if, during the period from June 7, 2018, to July 18, 2024, TVS Datasource, provided a Consumer Report concerning you for employment purposes.
The lawsuit concerns whether Datasource fully complied with the mandates of the Fair Credit Reporting Act. As part of this lawsuit, the parties have also reached an agreement concerning injunctive relief regarding certifications obtained in the future by Datasource. If you have received the Notice and Claim Form it's because the litigants have negotiated a settlement and Datasource’s records show that you may be entitled to a payment from the settlement as a member of one of the Classes described below. Datasource disputes any wrongdoing.
Certification Class: All individuals who were the subject of one or more Consumer Reports in which the Defendant failed to obtain a 15 U.S.C. §1681b(b)(1) certification immediately prior to producing a Consumer Report from June 7, 2018, to July 18, 2024.
§1681k Class: All individuals who were the subject of one or more Consumer Reports in which Defendant included matters of public record that were likely to have an adverse effect upon a consumer’s ability to obtain employment without giving contemporaneous notice or maintaining strict procedures from June 7, 2018, to July 18, 2024.
Adverse Action Class: All individuals who were the subject of an alleged adverse action taken by the Defendant in violation of 15 U.S.C. §1681b(b)(3) from June 7, 2018, to July 18, 2024.
